Notice of 995 Motion and Motion for Continuance of until Thursday February 26. 2004

  I, the Accused, in want of counsel, now ask this court to continue the trial until Thursday February 6, 2004. I am getting help in learning how to defend myself in ways that are unknown by the lawyers in this county. I am waiting to get the transcripts and complete discovery from the prosecutor. That makes it impossible for my legal counsel to know what happened. When the information comes to me, I will need help to understand how it applies to me. I have many motions to file and hearings to schedule, as I waive no Rights. I also know that public defenders are only effective for guilty people. They can make a deal because that takes no time. The innocent need more time. I, Pearl Timmerman, am innocent and need time to prove innocence.

   

   

                    Notice of 995 Motion

  I plan to do a 995 Motion and serve that within 10 days. A 995 motion can be appealed before trial. Therefore the trial must be continued because I intend to appeal them before trial.

Application for Order Shortening Time for service of this Continuance

       The trial should not have been set without having a hearing for the Omnibus Motion requested for Tuesday 16 December. I have not received a confirmation for this date from the Court. In fact, I feel that I am being hurried to trial without a foundation.

       Declaration of Accused re Court's arraignment

  I, Pearl Timmerman, declare the following under penalty of perjury: I declined to enter a plea at the arraignment other than what was stated in my filed and served papers. I objected to the prosecutor entering a plea, as he is not my counsel. I am in want of counsel of my choice. I intend to take appellate action if it becomes necessary.
