Response to Prosecutor Steven Lies:

Steven Lies,

There is no valid reason for your office to refuse the simple courtesy of an e copy of your response. There is a bad reason: you are attempting to impair Pearls 5th amendment right to counsel and her 1st amendment rights to associate.

Your name says it all. Pearl Timmerman is in pro per, you liar. Don't try to intimidate me, you corporate whore. If you think I am doing something wrong then speak up lad! Don't be shy. You are on the wrong side of the law here, pal. You and your client should back way off here and save your clients money and embarrassment. Your clients committed a serious violation of Pearl's civil rights. Your people jerked an innocent elderly woman out of her van and let her land on the pavement. For what crime? Driving around to see the Christmas lights! You should soft pedal this traffic court thing and mitigate your damages. If you drop the case today and apologize on behalf of your brutal cops, Pearl, being the compassionate Christian that she is, may forgive you and refrain from suing your corporate whore client.

One needs no license to speak, petition, counsel, and/or associate. Those rights may not be "abridged". Authority: http://www.lawyerdude.8k.com/3789.html I had no basis for suing you in federal court until you sent this veiled threat in an attempt to abridge my rights. I will consider a prompt apology and retractions as a basis for refraining from a lawsuit against you. Your tactic is a deceptive trick to extend a false offer of cooperation in order to violate Pearl's right to counsel. Deception, trickery, and failure to cooperate are a violation of the lawyer code of civil behavior which may or may not be committed to writing in your state.

To the extent that your state's monopolistic bar act abridges Pearl's rights it is void ab initio. Marbury v Madison. Your statute is overbroad. Authority: http://www.lawyerdude.8m.com/5409.html

I defend Pearl's rights vicariously. She defends mine vicariously. We associate under In Re Primus

http://www.lawyerdude.netfirms.com/primus.html and its progeny and ancestors.

We defend vicariously under the authority of Griswold and Boren v Craig which are found at:

 http://www.circuitlawyer.8m.com/griswold.html and http://www.lawyerdude.netfirms.com/craigvboren.html

There has long been authority that imported counsel may appear when local effective assistance of counsel is unavailable. Authority: the cases cited in Gilbert Law Summary on ethics.

If and when I appear in this case I will deal with the license issue. If I do an Amicus brief you may object to the filing of an Amicus. If I apply to appear pro hac vice then you may protest. If I simply file papers you may object. If I appear in court you may object. However, none of those things have happened.

The issue today is whether you will extend the courtesy of a mere 10 keystrokes to communicate your response to a pro per woman so that she can obtain counsel. The 1st amendment is my license. Warning, if you fail to cooperate we will seek appropriate redress by suing you personally in federal court.

Please tell me immediately if you will extend this courtesy of a txt copy to Pearl so that we can file the appropriate papers to vindicate her rights in this regard. Also we will be suing your secretary as she conspired in this conspiracy to deny to Pearl her civil rights.

I remind you that your prosecutorial duty is not to simply win. Your duty is to effect justice - not deny justice.

I urge you to do the right thing.

Date: Thu, 18 Dec 2003 11:12:57 -0600 Dear Mr. Palaschak, Would you please provide me with either the number your North Dakota license to practice law or the name, address and license number of the licensed North Dakota attorney with whom you have associated for purposes of this matter. If you are not licensed to practice law in North Dakota, please provide me with your license(s) number(s) and state(s) in which you are licensed to practice law. ----- Original Message ----- From: Attorney Douglas Palaschak To: pearlis@702com.net ; slies@liesandbullis.com Sent: Wednesday, December 17, 2003 1:51 PM Subject: Request for txt copy of pleadings. 11:50 Pacific time. Wed 17 Dec 2003. 8 days before Christmas. Hi, I received an urgent telephone call from Pearl Timmerman this morning regarding her case arising from a traffic stop. She says that she ran into an obstacle trying to obtain a txt copy of your response to her rule 12 motion. Pearl says that your secretary told Pearl that she will not send a txt e-copy unless I request it in writing. Here is the request from me in writing that your secretary requested. I am informed that the trial is scheduled for 48 hours from this moment. If I were to sent a letter, it would not get there in time. Therefore I make this request by this email. Pearl would be grateful for an e text copy. If you have the document on computer, it is a simple matter of several keystrokes to send an e copy to Pearl at pearlis@702com.net or to me at dlawyerdude@hotmail.com We would prefer WordPerfect, but we will settle for Word, txt, rft or any text format - but not photographic pdf. I thank you in advance for your anticipated cooperation. Also, I know that Pearl would be grateful for a stipulation to a continuance. There is no way that she can prepare an adequate surrebuttal in time. It is my experience that a traffic case, if well litigated, takes the same amount of time as any other adversarial action. ----Original Message Follows---- From: "PRT" To: "Lawyerdude@Yahoogroups.
