Lesson 27. How to get an extension of time.

Its your case; take control. If you need time then get time.


You may be surprised to discover that opposing counsel will nearly always cordially agree to an extension of time. After he agrees then you can tell the court that opposing counsel does not object.


As usual, you send this stuff by plain old first class mail.

            I, Susan Smith, ask the court to grant me an extension of 28 days until Wednesday 20 September 2006 to file my opening brief.

            I declare the following under penalty of perjury:

            This is my first such request.

            I received the transcript and record around 6 July. The lawyer who is writing the brief for me was on vacation for the last 3 weeks of July. We need more time to finish this brief.

            If you decline my request I ask that you notify me today at my cell phone 888 555 1212 so that I can mail the partial brief to you today 23 August, 2006.
