Withdrawal of Application for Writ.
I hereby withdraw my application submitted around November 19, 2007. I will attempt to resolve this issue at the trial court. At the trial court Judge Smith vacated the premature trial date thereby eliminating the crisis that triggered my original Application. There are 4 issues. I hope to resolve and clarify some of them at the trial court. I hope to separate the issues. Here are those issues:
1. The judge was biased. He researched and argued the case for the prosecution; the prosecutor did not participate. The judge usurped the role of prosecutor.
2. The judge did not submit his brief /argument to me in advance. He denied me the opportunity to rebut. He announced his brief/ precedent argument and his decision/ order simultaneously.
3. The judge supplied no e-copy of his main precedent. He supplied no paper copy. He supplied no hyperlink to the case.
4. The court reporter refused to provide e-transcripts. I will seek a local writ in that regard.
