Exhibit #8 8.jpg is “the 3% Letter” of Feb 1, 2000. This letter is my smoking gun #2. This letter is the memorialization of a void fraudulent deal between Joe Wortsmith the then living Robert Royce Kelly. This letter is signed by power of attorney exercised by his son, poseur Robert Sean Kelly. Query: 3% of what? The answer is this: I would expect that the 3% pertains to a royalty of 3% of the sales price of all items employing the patented device, but Defendant Bugos told me that Ryobi never pays a royalty and that they will only pay a fixe one time fee. Obviously Bugos and Wortsmith conspired to defraud the poseur brothers. They got their one time fee - sorta. Bugos promised them $30,000. If you so the math you will see that $30,000 is 3% of a one time fee of $1 million. The 3% was switched to a 3% remainder after a “sales commission” of 97% to Wortsmith. Re: RICO predicate crimes: This letter constitutes mail fraud. Wortsmith and Ryobi defrauded the poseurs by making them think that they would be getting a 3% royalty when in fact they were getting merely 3% of the $1 million sales price for the patent. The switch is done in the documents depicted in Exhibit 9 fraudulently entitled a “royalty agreement”.
