Lesson 11: How to get a status report from Lawyerdude.

People/ Litigants inquire of me about the status of their case. You want to know when your document will be ready. I can write most documents within hours of receiving the data. The problem arises when the client does not provide the data promptly. I ask these questions of the Litigants. The answers help me answer the Litigants.

1.         When you inquire, please write your client number in the subject line.

2.         Please write your telephone number in subject line.

3.         Please tell me the date of your next court appearance in the first sentence of your message. What event is scheduled for that day? What other dates and deadlines do we face?

4.         When did you last go to court? Is your history of court appearances listed in your chronology?

5.         The motion will not be heard at your next date; it will be heard on the date that I designate in the caption of your motion. Remember that I will set the date for your motion. I will set the motion at least 4 weeks from the date that you file my motion. I set the hearing for a Tuesday or a Thursday in the afternoon.

6.         Please remind me what I am writing for you.

7.         If the court reporter is being obstinate, then we turn that lemon into lemonade by perhaps a motion to dismiss, but first we do the reasonable thing and ask her to do the right thing. We ask her by email and/ or letter.

8.         If you don’t have your file yet then we can turn that lemon into lemonade. Often the prosecutor and public defender will refuse to give you the file. Once again: A motion to dismiss may be the ultimate remedy but first we must make a written effort reminding these players of the law.

9.         If there is no written complaint then we should move to quash the prosecution.

10.       If there is no action by the prosecutor then we move to dismiss with prejudice to prevent him from jumping in later in the game.

11.       If the judge errs we can seek a pre-trial writ.

12.       Please review and upgrade and send me your upgraded chronology, list of players, etc.
