Lesson #8: How to debrief; use the format of a chronology and list of players.

 Did you go to court today or yesterday or recently? If so, the please de-brief with me after court as follows. De-brief in the format of a partial chronology and partial lists.

1.         Call or email me and tell me that you did not go to jail. When is your next court date? What is the event for that day? Send me an email telling when your next court date is.

2.         Take some time to write about what happened in court. Tell your story in the format of a Partial Chronology and Partial list of players. Begin every paragraph with a date. Make a list of all the people in today’s chronology. I explain how to write a partial chronology here: http://www.lawyerdude.netfirms.com/8854.html You may want to upgrade your chronology. I explain below how to upgrade your chronology which is that numbered document that contains your chronology, list of dossiers for the players, list of documents, etc.

3.         Criminal court is a success if you did not go to jail.

            a.         Criminal court is a success if you moved farther down the time line without entering a plea.

            b.         Criminal court is a success if you controlled the pace of your case.

            c.          Criminal court is a success if you caught the prosecutor in a lie, negligence, or other malfeasance. Be sure to talk about this lie in the narrative in your written chronology.

            d.         Criminal court is a success of they denied you a fundamental right that can trigger an issue for pre-trial application for a writ.

4.         Order an e- transcript. If there was no court reporter then email me and request that I write an application for writ of mandate to compel a court reporter to appear.

5.         Have you been arraigned yet? If so, when. It is likely that they did not advice you in writing of your rights. If they advise you then they likely advised you erroneously. They don’t know your rights.

6.         Did you file something today? If so please fax to me a copy of the file-stamped front page. Tell me the document number of the document that you filed. I will post it.

7.         Here is how to upgrade your chronology:

                         i.           I have published your chronology on the internet. Here is one for example:

                         ii.          If you don’t feel up to the task of upgrading your chronology, that is okay also. Just send me $34 and I will do it. Call me and I will send you a link. You can use your credit card.

                         iii.         Your chronology is on the internet. If not, then tell me and I will send you the link. Download the html version or any version and upgrade it. Then affix a version number and send it to me by email. You will lose my formatting but I am happy to format it. I ask that you do your part; your duty is to provide the data. This will take time - especially if you don’t type. If you don’t type then drive to Office Depot or Stapes and buy a cd rom that teaches you to type, dumbass.

                         iv.         Tell me who were the players in court. Name the following of today’s players in court: Court reporter, Judge, prosecutor, you, whoever was with you in court, your lawyer (if any), their witnesses. Gather the information and upgrade their dossiers in order that you may telephone and write to the court reporter and demand an e-transcript.

                         v.          Scan or copy any papers that you received that day and email or mail them to me. If you were as smart as Forrest Bishop you would upload them and send me a link.

                         vi.         Tell me the name, telephone number, email address, and postal address of the today’s court reporter.

                         vii.        Order an e-transcript - and remind the court reporter that California Rule of Court 4f4 entitles you to an e-transcript. Remind her, if necessary, that Griffin v Illinois (1956) http://www.circuitlawyer.8m.com/griffin.html entitles you to a free transcript! If the court reporter does not understand then I can call her. The court clerk can tell you the telephone number, name, and address of the court reporter. The number for the court clerk is printed on every paper that I write for you. It is right there at the top of the caption where the court name is listed. Remember? This is one of the items that you gave me in the list of players. The court is one of the players.

                         viii.       Write a narrative about what happened today. Insert this narrative into the chronology.

                         ix.         Upgrade the “list of documents” section of your chronology document. Today’s transcript is a document. List it! Even though you don’t have it, list it anyway.
