Important fact: I personally don’t know anybody who ever won a section 1983 case! Update: Mike Andrus has survived the dismissal motion in his section 1983 case and is well on his way to a trial against the corrupt state actors in his case. His complaint is listed and linked below. I do know people who were stupidly counting on the money from their section 1983 case in order to pay the rent. This is an unrealistic expectation. People just don’t have the perseverance in the face of police state judges and their suck up students clerks. However, I was not winning traffic tickets in the beginning either. Now I am winning in traffic court and I have learned the pitfalls to avoid in section 1983 cases. One pitfall is trying to sue the entire state - like we all do. For example: Drake Ward’s complaint, listed below, sues the attorney general for failure to supervise the district attorney. Hmm. I would delete that one defendant, the attorney general.

1. Section 1983 complaint by Raymond Eric Zahler of Washington state. Raymond’s class action is very important ! He challenges the county policy which reserves the law library for lawyers only. 2. Section 1983 complaint for Ron Fox of Bay City, Michigan: “Out to get me” Falsely accused of a sex crime. Complaint was filed around 25 August 2005. http://www.lawyerdude.netfirms.com/7045.htmlRon filed an amended complaint on 23 Dec 2005. The federal court in Bay City transferred this case to Detroit. I don’t know why. And Ron isn’t finding out; he isn’t asking.

3. Lisa Reed of Santa Rosa, California. This is a fresh case. She has not decided to file yet. http://www.lawyerdude.netfirms.com/lisareed.html Lisa sells musical instruments. She does not want to be a tax collector but the state makes her enforce their sales tax law. They could do that to a corporation but they cannot do it to a human. They must pay her! She fell behind in her collection efforts. Recently she offered to pay the entire $5000 in taxes that she collected for the state. She sent a man to the tax office with $5000 cash! He tendered the money. The Franchise Tax Board would not accept her tender in full. A tender constitutes payment. They want to whack her with fines and jail. In fact they threw her in jail until the judge granted Lisa O.R. We will soon be filing a section 1983 complaint unless they make a settlement with Lisa. They have essentially enslaved Lisa. They don’t pay her for her tax collection work. They do this to lots of people.

4. Section 1983 complaint by Theophilos Luis Deligiannis of Anaheim, California: Keyjacking by cop: http://www.fu.gq.nu/6704.html Theo dropped this case. Strange. He will file another case in a different incident. That complaint is listed next.

5. Second case by Theo from Anaheim, California: http://www.fu.gq.nu/theo.html To be filed around Christmas 2005.

6. Mike Andrus of Hurricane City, Utah: http://www.lawyerdude.netfirms.com/andrus.html He filed an earlier version and survived a motion to dismiss. I wrote this version to satisfy Judge Kimball’s request that Mike amend the complaint to clarify the causes of action. I kinda think that Mike filed his own amended complaint more like his original complaint.

7. Section 1983 complaint for Drake Ward of Lake Isabella CA. We upgraded the amended complain because after he filed the original complaint, one of the cop defendants put a gun into Drake’s side and told Drake that he could blow him away and get away with it. Frankly, I don’t believe the story for a minute. Nonetheless, I am a concerned. Since I edited this for Drake, I have not heard from him. 16. There is a case that I filed regarding traffic cases in Ventura. I filed it in federal court around 1988 I am guessing. I must find it.

17. I wrote a winning RICO case against the gangsters who crashed my client’s helicopter. This was in federal court in Ohio. Thereafter Dick Drost fired me and then settled the case for the full amount of the insurance policy - which I could have done years earlier.
