Motion for Indefinite Continuance of Arraignment until 1 week after I receive police report ##2-36250 and the “confidential” information information in my court file.
I, the Defendant, now ask this court to continue this arraignment until I have had a week to read and respond to Crime report 2-36250 and whatever else was refused to me when I had my file copied.
On 12 November 2002 I appeared at the records window intending to purchase a copy of my file. I was informed that the file was on its way to court - 48 hours in advance. Thereafter On November 14th I filed document # a written request for a copy of police report #2-36250. On November 26th I made a 3rd effort to obtain the police report. I presented myself at the files window. I obtained most of my file and a certificate from the clerk. I have appended these to this motion.
It is standard practice for counsel to be completely informed prior to making a plea. I want to be completely informed. Therefore I ask for a continuance or, in the alternative, dismissal.

Declaration of Defendant Regarding Attempts to Obtain Police Report and Confidential Document.
Request/ Demand for copy of court file.
Having asked and been denied on the 12th and 14th, I appeared a 3rd time on 26 November. I appeared at the window again. I received 9 pages from my file, and a certificate from the clerk. The certificate says that the clerk did not give me a confidential paper in my file. She sais that she would not give them to me because I did not have a picture ID. When Sandi Hatmaker went to the copying machine I observed that she left several sheets of paper in the file; she did not copy these. I suspect that this is the police report. I demand at least a redacted copy. A copy of the certificate and the 9 pages is attached.

Proposed Order
The clerk is hereby directed to give to this defendant a copy of those several papers that were refused to him previously. The clerk is hereby directed to permit defendant to look through his court file to ensure that he has seen all the papers in the file. If the defendant has not been given the report and confidential material by December 17th then the case against him shall be dismissed. This case is continued until Thursday 26th December for further action in this regard.
