I would like a 2 week continuance but that is Thanksgiving so I ask to continue this to the Tuesday after Thanksgiving, Tuesday 3 December, 2002 so that I can read what is in my file and decide what will be my plea - or if I will demur. I cannot make a plea today because I have not seen my accusation from the prosecutor. I will need to consult with counsel.

I ask that the warrant be recalled. I did not intentionally miss court.
Declaration of Jan Tegard regarding Failure to Appear.
I, Jan Tegard, declare the following under penalty of perjury: I have lived with the defendant for 18 years. On 22 May 2002 I called the court to take care of this ticket. Charlie received the ticket on 27 April. May 27 was Memorial Day - but the ticket said to appear 24 May. The person from the court said “Oh, we sent that back to the Sheriff because we are not open on that day . . . If you don’t receive anything in the mail by your court date, then don’t worry about it”.
I said “Won’t we get in trouble?” She told me not to worry about it.
Nothing came in the mail. Because of Charlie’s position regarding driver license we thought that they just dropped the case. We were surprised when the Deputy came to our door. Charlie did not intend to miss court. We simply got our signals crossed.
